Please read these Terms and Conditions carefully before using the website and our provided service operated by SkyBox Ltd.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Changes to Terms and Conditions:
Virtual Reality (VR): Virtual reality is a computer-generated scenario that simulates a realistic experience.
Augmented Reality (AR): is a live direct or indirect view of a physical, real-world environment whose elements are "augmented" by computer-generated perceptual information, ideally across multiple sensory modalities, including visual, auditory, haptic, somatosensory, and olfactory.
Service: The reached agreement between Skybox Ltd. and it’s partner. The service is bound to the contract signed from both parties.
Content of our Services:
Skybox offers personalized services in the field of VR and AR.
Our services and the creation of our content will start as soon as an agreement has been set between Skybox Ltd. and the requesting company/museum. Beforehand a 6 to 12 month plan will be set out by both parties regarding the implementation of our services. Any change of plan will be notified a month in advance and must be accepted by both parties. Our services will vary regarding the demand from the external party, a contract will be signed by both Skybox Ltd. and its partner in this regard. The contract must be followed under all conditions and an obstruction to do so in the future will lead to a direct termination. The monthly fee museums need to pay will under all conditions remain in place and end on the date stated in the contract even under a termination.
Any type of content created by Skybox Ltd or any of its team members will belong to Skybox Ltd and its shareholders. All content that Skybox Ltd develops for any customer or museum will be given to the museum and/or institution until the date stated on the contract or agreement signed by both Skybox Ltd and its partners. All content that is on display will have to be presented under the name of Skybox Ltd as an alliance with the museum or organization.
Subscriptions & Payment Terms:
Prices to implement Skybox will vary depending on the cost and type of project required by the museum or organization. The costs and payments must be set beforehand on a signed agreement. Usually the payments will be a yearly fee for the service plus the development of the project at early stage. Again, this depends on the signed contract. If payment does not follow the initiated contract the service will be dropped immediately and all content owned by Skybox ltd. may not be used.
Payment terms are dependent on the contract signed between both parties.
Except as otherwise specifically permitted in these Terms, you may not, and may not permit any third parties to: (1) modify or create derivative works of the service provided, without limitation, by performing any translation or localization; (2) copy the VR Content (except in the course of downloading the VR Content for use in museums for the limited purposes set forth in the License); ( (3) reverse engineer, decompile, disassemble, translate or otherwise attempt to derive the source code for the Service provided or the Site; (4) redistribute, transfer, encumber, sell, rent, lease, lend, sublicense, or otherwise redistribute the VR or AR Content or the Site, or any portion thereof; (5) remove or alter any trademark, logo, copyright, or other proprietary notices, legends, symbols, or labels in the content or on the site, or any portions thereof; (6) violate any applicable laws, rules and regulations, including but not limited to, infringement or misappropriation of any intellectual property rights; (7) intentionally disrupt the Site or use the Site to upload, reproduce, transmit or distribute any software viruses or other computer code, files or programs designed to interrupt, destroy, degrade or limit the functionality of any computer software, hardware, data, system or telecommunications equipment.
You acknowledge and agree that, as between us, Skybox is the sole and exclusive owner of the content/service it provides, including but not limited to, in all intellectual property rights therein. Nothing from the VR & AR service provided may be used for any purposes other than those granted in the License, nor the right to use any content or property of any third party. Your use of the site or the service also implies no right of any kind in any trademarks, logos, names, designs or intellectual property held by Skybox Ltd. You represent that you will not take any actions that would impede, limit or alter Skybox’s right in its intellectual property, including but not limited to any trademarks or copyrighted content.
The License granted herein will remain in effect, unless terminated by Skybox. Skybox may terminate the License if you breach any term of these Terms. Upon termination, you must, at Skybox’s option, either promptly destroy or return to Skybox all copies of the Skybox Content in your possession or control and immediately cease all access to the Site. If the termination is caused from breach of terms and conditions the service provided by Skybox Ltd. will be removed but the payment plan will continue until a set date in the decided contract between both parties. If the termination is found by an agreement of both Skybox and its client a termination of the contract will be imminent and payment fees and service will be dropped.
This contract will be governed by and construed in accordance with the laws of the United Kingdom and shall be subject to the non-exclusive jurisdiction of the court of Great Britain
